mybet welcomes EuGH paper on online gaming by the Federal Court of Justice

Kiel, January 24, 2013 - The Federal Court of Justice today emphasised its
concerns at plans to ban games such as casino and poker on the Internet. In
forming their opinion the Federal Court of Justice's judges made reference
to the regular legal position of the European Court of Justice (ECJ), which
demands coherent, systematic framework conditions for the offering of
gaming throughout all EU member states. Against this backdrop, the Federal
Court of Justice today submitted a number of questions to the ECJ on the
reorganisation of gaming law in Germany

The critical issue in the opinion of the Federal Court of Justice is that
the parallel existence of more liberal legislation in Schleswig-Holstein
and the Internet permits for sports betting, casino and poker granted on
this basis to private operators means there is a lack of the required
overall coherence to legislation in Germany. However, according to the
strict requirements of the ECJ, precisely this is a basic requirement for a
restrictive policy towards gaming, such as that enshrined in the State
Treaty by the other 15 federal states. Even if Schleswig-Holstein signs up
to the State Treaty on gaming of the 15 federal states - on which a
decision is to be taken by the Kiel state parliament today - it would
potentially be impossible to restore the required coherence. In order to
prompt a supreme-court decision, the Federal Court of Justice stayed
proceedings and submitted these questions to the ECJ for clarification.

Mathias Dahms, Management Board spokesman of the Kiel-based mybet Holding,
commented: 'In referring the proceedings to the ECJ the Federal Court of
Justice has highlighted what is already clear to the educated consumer:
there is now a need for comprehensive regulation of online casino and poker
games in Germany. A ban - as is envisaged in the State Treaty on gaming of
the 15 federal states - will not work. In our opinion the State Treaty on
gaming needs to be fundamentally overhauled. The premiers of those states
would be well-advised to dispense with their restrictive regulatory model
and use the arrangements currently in place in Schleswig-Holstein as their
basis. Schleswig-Holstein needs to think long and hard about whether it can
seriously sign up to the questionable legal construct that is the State
Treaty on gaming.'
