With reference to the captioned subject and pursuant to Customs Notification no. 25/2021, anti-dumping duty om imports of Polytetrafluoroethylene (PTFE) falling under the tariff item 3904 61 00 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975), the designated authority, vide its final findings in notification No. 15/11/2016-DGAD, dated the 23rd June, 2017, published in the Gazette of India, Extraordinary, Part I, Section 1, dated the 23rd June, 2017, it is recommended for imposition of the anti-dumping duty on Polytetrafluoroethylene or PTFE.

However, Hitachi Energy India Limited (the Company) has imported PTFE but inadvertently missed to file the anti-dumping duty while filling the documents for the import before the Customs authority. Query was raised by Customs authority and after scrutinizing the same along with reference to Customs notification no. 25/2021, it was determined that the anti-dumping duty has to be paid by the Company.

In this regard, the Commissionerate passed Order in Original, dated May 16, 2024, ADJ F.No.: S/10-Adj-06/2024- 25/Gr.2/ACC and CAO. No.: JC/HK/17/2024-25/Adj(I)/ACC charging Fine and Penalty. name of the authority: Office of Commissioner of Customs (Import), Appraising Group II, Air Cargo Complex, Sahar, Andheri (E), Mumbai 400099.
