DEMOCRATS IN THIS CITY WERE REELING YESTERDAY: President Biden is now under criminal investigation, as is Donald Trump, over the handling of top secret documents.

DEMOCRATS WORRY ABOUT WHAT MIGHT COME NEXT: Are there more documents? Could an aggressive special counsel dig up damaging information? Will Republicans score political points? Has Biden hit a pothole in his path toward nomination for a second term?

WE TALKED WITH DEMOCRATS yesterday about this stunning turn of events, and they all asserted - adamantly - that Biden's alleged transgressions aren't as blatant as Trump's. But this argument misses the point: Biden now faces a special prosecutor, and for most Americans, there will be a sense that both he and Trump are tainted.

EVERYONE WE TALKED WITH had this common refrain: "What was Biden thinking?" How could he leave these documents in his garage? Perhaps it was sloppy record-keeping, perhaps it was inattention to details, or perhaps it was an attitude that the rules didn't apply to him.

FOR REPUBLICANS, STILL RECOVERING from their cringe-inducing spectacle in the House, this is a gift from God. The GOP already has planned several hearings on alleged corruption in Biden's family, and hard-line GOP activists believe they can put
together an impeachment case.

THERE'S ABSOLUTELY NO CHANCE that impeachment could succeed in the Senate, where a two-thirds vote is required to convict, and there's a likelihood that anti-Biden Republicans could over-play their hand. But Democrats on Capitol Hill are bracing for new disclosures; they're clearly on the defensive.

DESPITE AN UPTICK IN BIDEN'S job approval rating, and signs that inflation has
peaked, a surprisingly large percentage of Democrats are lukewarm about nominating Biden for a second term. And several major players - including Govs. Gretchen Whitmer in Michigan and Phil Murphy in New Jersey - are ready to run if Biden drops out.

THE PROSPECT OF RELENTLESS REPUBLICAN INVESTIGATIONS - with more disclosures to come - has persuaded some Democrats we talked with yesterday to question whether Biden is a sure bet to run again.

WE HAVE BEEN OUTSPOKEN THAT BIDEN could decide not to run, largely because he would be 86 years old at the end of a second term. But he had a surprisingly successful second half of 2022 and has told party insiders that he's running again.

OUR SENSE is that he country doesn't want another Biden-Trump race, with the same tired allegations from both of them. Voters want a different choice - not two
candidates who are under criminal investigation.
