NATIONAL TREASURY NO. R.32 20 JANUARY 2017 PREFERENTIAL PROCUREMENT POLICY FRAMEWORK ACT, 2000: PREFERENTIAL PROCUREMENT REGULATIONS, 2017

The Ministerof Finance has, in terms of section 5 ofthe Preferential Procurement Policy Framework Act,2000 (ActNo.5 of2000), made the regulations set out in theSchedule.

    Definitions

  18. In these Regulations,unless the contextindicates otherwise,any word orexpression to which ameaning has been assigned in the Act must bear the meaning so assigned-

  19. "B-BBEE"means broad-based black economic empowerment as defined in section 1 of the Broad-Based Black Economic EmpowermentAct;

    "B-BBEE status level of contributor"means the B-BBEEstatus of an entity interms of a code of good practice on black economic empowerment issued in terms of section 9(1) of the Broad-Based Black Economic EmpowermentAct;

    "blackdesignated groups"has the meaning assignedto it in the codes of good practiceissued in terms of section 9(1) ofthe Broad-Based Black Economic EmpowermentAct;"blackpeople"hasthe meaningassigned toit in section 1 of theBroad-Based Black Economic Empowerment Act;

    "Broad-BasedBlack Economic Empowerment Act"means the Broad-Based Black Economic Empowerment Act,2003 (Act No.53 of 2003);

    "co-operative"meansa co-operative registeredin terms of section 7 ofthe Co­ operatives Act, 2005 (Act No.14 of 2005);

    "designated group"means-

  20. black designated groups;

  21. black people;

  22. women;

  23. people with disabilities; or

  24. small enterprises, asdefined in section1 ofthe National SmallEnterprise Act,1996 (ActNo. 102 of1996);

  25. "designated sector"means a sector, sub-sector or industryor product designated in terms of regulation 8(1)(a);

    "EME"means an exempted microenterprise in terms of a code of good practice on black economic empowerment issuedin termsof section 9(1) of the Broad-Based Black Economic Empowerment Act;

    "functionality"means the ability of atenderer to provide goods or servicesin accordance with specifications as set outin the tender documents;

    "military veteran"has the meaning assigned to it insection 1 of the Military Veterans Act, 2011 (Act No.18 of 2011 );

    "NationalTreasury"has the meaningassigned to it in section 1 of thePublic FinanceManagement Act,1999(Act No.1 of 1999);

    "people with disabilities"has themeaning assigned toit in section 1 ofthe Employment EquityAct,1998(Act No.55 of 1998);

    "price"includesall applicabletaxesless allunconditional discounts;

    "proof of B-BBEE status level of contributor"means-

    1. the B-BBEEstatus level certificateissued by an authorisedbody or person;

    2. a sworn affidavit as prescribed by the B-BBEECodes of Good Practice; or

    3. any other requirement prescribed in terms of theBroad-Based BlackEconomic Empowerment Act;
