NOTICE FOR SALE OF IMMOVABLE PROPERTY ISSUED UNDER THE SECURITISATION AND RECONSTRUCTION OF FINANCIAL ASSETS AND ENFORCEMENT OF SECURITY INTEREST ACT 2002, (hereinafter referred to as Act) r/w SECURITY INTEREST (ENFORCEMENT) RULES, 2002(hereinafter referred to as Rules).

Whereas The Authorized Officer of the Federal Bank Ltd. under the Act issued a demand notice dated 31- 03-2023 calling upon the borrower(s) and / or guarantor (s) and / or defaulters 1. 1)M/s Abayadvay Crates and Pallets, a partnership firm having its office at No. 271/1B, Main Road Molachur Village, Thiruvallur Sunguvachatram Post, Sriperumbudur, Kancheepuram, Tamil Nadu - 602106 represented by its partners (a) Rajesh Kumar T K, S/o Kumaran T K, and (b) Sudheesh Kumar T S, S/o Sundaran T A 2)Rajesh Kumar T K, S/o Kumaran T K, Thalore Kalarikkal House, Tikkur, Thrissur, Konikara, Kerala -680306 3) Sudheesh Kumar T S, S/o Sundaran T A, Thichoor House, 1st Street, Uma Nagar Kolazhy Post, Ollur via, Thrissur, Kerala - 680010 4)Sajini K V, W/o Sudheesh Kumar T S, Thichoor House, 1st Street, Uma Nagar Kolazhy Post, Ollur via, Thrissur, Kerala - 680010 5)Anima P alias Amina Rajesh, W/o Rajesh Kumar T K, Thalore Kalarikkal House, Tikkur, Thrissur, Konikara, Kerala -680306 to pay the amount mentioned in the notice being a total sum of Rs. 79,39,172.57 (Rupees Seventy Nine Lakh Thirty Nine Thousand One Hundred Seventy Two and Paise Fifty Seven Only) consisting of Rs.38,52,026,72 (Rupees Thirty Eight Lakh Fifty Two Thousand and Twenty Six, paise Seventy Two only) under the Cash Credit limit with number 15635500000993, Rs.10,33,631.85 (Rupees Ten Lakh Thirty Three Thousand Six Hundred and Thirty One, paise Eighty Five only) under Term Loan with number 15636900000567,Rs.4,19,445/- (Rupees Four Lakh Nineteen Thousand Four Hundred and Forty Five only) under Term Loan with number 15636900000575 , Rs.4,19,396/- (Rupees Four Lakh Nineteen Thousand Three Hundred and Ninety Six only) under Term Loan with number 15636900000583, Rs.12,13,354 (Rupees Twelve Lakh Thirteen Thousand Three Hundred and Fifty Four only) under GECL with number 15636900001144 , Rs. 10,01,319/- (Rupees Ten Lakh One Thousand Three Hundred and Nineteen only) under Term Loan with number 15636900001540, together with future interest till the date of payment and costs and other charges within 60 days from the date of receipt of the said notice.

Whereas the borrower(s) and / or guarantor (s) and / or defaulters having failed to repay the amount within the stipulated time, the authorized officer on behalf of the Federal Bank Ltd. has taken possession of the property described herein below by of powers conferred under section 13(4) of the said Act read with Rule 8 of the said Rules on 11-10-2023 by issuing a notice to the borrowers/defaulters and general public and publication thereof in newspapers as contemplated under the said Act and Rules.

The undersigned hereby give notice to the borrower(s) and / or guarantor (s) and / or defaulters and general public that the Bank has decided to sell on 18th June 2024 the property described herein below on " As is where is", "As is what is" and "Whatever there is " under Rules 8 & 9 of the said Rules for realizing the total dues of Rs. 74,90,327 (Rupees Seventy-FourLakh Ninety Thousand Three Hundred and Twenty Seven Only) consisting of Rs. 47,46,963.65 under the Cash Credit limit with number 15635500000993, Rs. 4,14,125.35 under Term Loan with number 15636900000567, Rs. 12,28,237/- under GECL with number 15636900001144, Rs. 11,01,001/- under Term Loan with number 15636900001540 together with interest at the contractual rates with monthly rests from 19-06-2024 till realization and thus the undersigned hereby invites from interested parties the e-bids for purchasing the property subject to the terms and conditions mentioned hereunder.

2. All the piece and parcel of the land measuring 1.606 Cent or 0.0065

Hectare together with all other improvements thereon comprised in

Re-Sy No. 427/8 (Old Sy No. 766/1), Block No. 52 of Kolazhy Village,

Thrissur Taluk, Thrissur District, Kerala State within the registration

Sub District of Thrissur, bounded as per title deed on East by: Sched-

ule 1 Property in title deed, West by: Property of Chiyarath Johnson,

North by: Property of Chiyarath Johnson and South by: Schedule 1

Property in title deed.

And commonly bounded as per location sketch on East by: Property of

Mundamkulam Gopalan, West by: Road and Property of Chirayath

Johnson, North by: Property of Chirayath Johnson and Kottakkal Kannan

and South by: Nadavazhy.

Terms and Conditions

  1. Auction sale/bidding would be only through "ONLINE ELECTRONIC BIDDING" process through the website www.bankeauctions.com of M/s. C1 India Private Limited.
  2. The property will be sold on "AS IS WHERE IS" "AS IS WHAT IS" and "WHATEVER THERE IS" basis for an amount above the RESERVE PRICE.
  3. The Earnest Money Deposit (EMD) which is equivalent to 10 % of the Reserve Price of the property concerned is Rs.4,65,000/- (Rupees Eight Lakhs Eighty Thousand Only), which is refundable if the tender is not accepted.
  4. The EMD shall be submitted on or before 17-06-2024, latest by 05:00PM. Any bid submitted beyond the date and time referred above will not be entertained. If the bid form is submitted by an incorporated company, the person representing such company shall submit / produce the true copy of resolution / authorization from the company.
  5. All payments shall be made by way of Demand Draft drawn in favor of The Federal Bank Ltd. payable at Chen- nai or by RTGS/NEFT (A/c No. 14082200000026, IFSC: FDRL0001408).
  6. The auction will be conducted online between 11:00 AM and 12:00 PM on 18-06-2024, with unlimited ex- tension of 5 minutes each.
  7. The auction would commence above the reserve price mentioned. Bidders shall improve their offers in mul- tiples of Rs.25,000/- (Rupees Twenty Five Thousand Only)
  8. The intending bidders shall hold a valid e-mail address and register their names at the portal and get their user id and password from M/s.   9. The Federal Bank Limited / M/s. C1 India Private Limited shall not have any liability towards bidders for any interruption or delay in access to the site irrespective of the cause.

  11. The intending purchasers can inspect the properties between 03.00PM and 05.00PM on 29th of May 2024 in consultation with Br. Poonamally.
  12. The successful bidder shall deposit 25% of the bid amount / sale price (inclusive of EMD) immediately on acceptance of his tender/ offer by the Bank and the balance 75% within 15 days or such further time as permitted by the authorized officer in accordance with law, failing which the entire deposit inclusive of EMD remitted shall be forfeited without any notice and the property will be re-sold.
  13. The successful bidder shall bear the entire charges/tax/fees payable for conveyance such as stamp duty, registration fee etc as applicable as per law.

  1. The Bank will not be held responsible for any charge, lien, encumbrance, property tax or any other dues to the Government or anybody in respect of the property under sale. The encumbrances, if any, should be cleared by the purchaser of the properties.
  2. The Authorised officer has the absolute right to accept or reject all or any bid including the highest bid or adjourn/postpone/cancel the sale without assigning any reason. The decision of the Authorised Officer/Bank shall be final.
  3. The buyer should satisfy himself/ herself / itself as to the title, extent, ownership, statutory approval etc. in respect of the properties concerned before participating in the auction.
  4. If any of the dates mentioned above happen to be a holiday/harthal/protest called by any political parties/as- sociation/ groups which adversely affects the functioning of the Bank / M/s. C1 India Private Limited, the very next Bank working day may be considered for that event and related events including the date of auc- tion/sale.
  5. The property is put for sale subject to the provisions under the above Act / Rules and other prevailing laws.
  6. The borrowers/guarantors named above shall treat this as notice of Thirty days as stipulated in Rule 8(6) read with Rule 9 of the said Rules and pay the secured debt in full to avoid sale of the secured property.
